Narrations of the Prophet (Nabavi) from the works of the Sunnis and the Shias along with narrations from the Ahl al-Bayt (peace be upon them all) in this matter, has been gathered and studied in this article. Part of those narrations has sayings or deeds of the Prophet (s.a.w) and the Imams that quote for a death penalty of those who insult the Prophet (s.a.w). Others order on execution of the death penalty and some other ones include the evidence of Sahabahs’ (Companions) actions on executing the death penalty on the insulter of the Prophet (s.a.w). The author has deducted the penalty of the one who insults the Prophet (s.a.w) from all three traditions. More so he has quoted cases of penalty execution on this matter in the era of the Prophet, era of the Imams and era of the Imam’s absence, specifically those penalties that were taken to an effect based on the Prophet’s (s.a.w) order or an Imam or it was done at their presence, from the historical books and it has used them to deduct the penalty of insulting the Prophet. At the end it verifies and insists on the penalty of Insulting with a report of Shia and Sunni scholars and Jurists’ views and sayings on the penalty and explaining the consensus quotes and their results. استنباط حکم سابّ النبی ص از «سنّت اسلامی» و «حدیث»، مسئله و هدف این پژوهش است. در این مقاله، مجموعه احادیث نبوی موجود در آثار اهل سنّت و شیعه پیرامون کیفرسبّ پیامبرص و افزون بر آن، احادیث اهل بیت ع در باره مسئله، تحقیق و بررسی گردیده است. برخی از این احادیث، سنّت قولی و گفتار پیامبرص و امامان را در باره حکم قتل ناسزاگوی به پیامبرص گزارش کرده و برخی، دستور بر اجرای کیفر قتل را بیان نموده و برخی نیز، تقریر و تأیید اقدام اصحاب بر قتل سابّ النبی ص را در بر دارد. محقق از هر سه قسم سنّت، مجازات سابّ النبی را استنباط نموده و در این راستا، موارد اجرای این کیفر در عصر رسالت، عصر امامت و عصرغیبت، به ویژه مجازات هایی را که به دستور پیامبرص و امام ع یا پیش روی ایشان انجام شده است، از کتاب های تاریخی نقل نموده و از آنها، نیز برای به دست آوردن حکم سابّ النبی استفاده کرده است. سرانجام، با گزارش اجماع فقهای شیعه و اهل سنّت برحکم و تبیین اجماعات منقول و محصّل فقیهان و مجتهدان، کیفر سابّ النبی را مورد تأیید و تأکید قرارداده است.   برای دریافت اصل مقاله، از نورمگز و یا مگیران ، آدرس های زیر را کپی و در نوار آدرس مرورگر خود وارد نمایید:<br /> مگیران:  https://www.magiran.com/paper/1441068 نورمگز: https://www.noormags.ir/view/fa/articlepage/1070349 http://fvh.journals.miu.ac.ir/article_1557_4033316141c9c44e7e130a490a64f953.pdf
