The present paper at first has studied the common safeguards of judicial security in Imamiah jurisprudence and criminal law system of Afghanistan, and then the special safeguards of judicial security in the initial researches stage have been studied in the criminal justice system of Afghanistan and the viewpoints of Imamiah jurists also have been explained where needed. According to the findings of the research, popular principle like legality of the crimes and punishments, presumption of innocence, equality before the law and personality of criminal liability are ruling on judicial security and must be applied in all the stages of trial, otherwise the judicial security is not established. Furthermore, there are some criteria in the initial researches stage which is one of the most important stages in the secular systems of trial disregarding of which endangers judicial security. The defendant has also rights in this stage, ignorance of which is ignorance of fair hearing and consequently lack of judicial security. امنیت قضایی تضمین‌کننده حقوق همه کسانی است که در یک دعوای کیفری دخالت دارند. در این تحقیق، ابتدا تضمین‌های عمومی امنیت قضایی در فقه امامیه و نظام کیفری افغانستان مورد بررسی قرار گرفته و سپس تضمین‌های خاص امنیت قضایی در مرحله تحقیقات مقدماتی در سیستم دادرسی کیفری افغانستان بررسی و در موارد لزوم دیدگاه فقهای امامیه نیز تبیین شده است. بر اساس یافته‌های پژوهش، اصول عامی مانند اصلِ قانونی‌بودن جرایم و مجازات‌ها، اصلِ برائت، اصلِ تساوی در برابر قانون و اصلِ شخصی بودن مسؤلیت کیفری جزو اصول حاکم بر امنیت قضایی است و بایستی در تمام مراحل دادرسی اعمال گردد. در غیر این صورت امنیت قضایی تحقق نخواهد یافت. با این حال در مرحله تحقیقات مقدماتی که یکی از مراحل مهم و حساس در سیستم دادرسی‌های عرفی است، معیارها و ضوابطی وجود دارد که عدم رعایت آنها امنیت قضایی را با خطر مواجه می‌سازد. همچنین در این مرحله متهم دارای حقوقی است که نادیده گرفتن آنها به معنای نادیده گرفتن دادرسی منصفانه و به تبع آن عدم وجود امنیت قضایی خواهد بود.<br /> <br />برای دریافت اصل مقاله، از نورمگز و یا مگیران ، آدرس های زیر را کپی و در نوار آدرس مرورگر خود وارد نمایید:<br />مگیران:<br /> https://www.magiran.com/paper/1815083<br />نورمگز:<br />https://www.noormags.ir/view/fa/articlepage/1327834 http://fvh.journals.miu.ac.ir/article_1613_aab5ca47b156c5cb96ca52a5cd41f34c.pdf
