Given that the term human rights is consisted of “Right” and “Human” its definition depends on explanation of the concepts of the two words. Disagreements about the nature of Right and Human have made it difficult to offer a comprehensive definition of human rights. The present paper has explained the meaning of human rights by discussing the different ideas about the meaning of Right and the viewpoints of Islam and the modern human rights about Human, and finally considers the following statement as the common definition among all the definition: “human rights belong to the mankind by itself and no additional condition is taken in enjoying these rights”. But due to controversies about the nature of Right and Human, these rights have been interpreted in different ways. Likewise, these different interpretations have caused the concept to be used only for modern human rights در این پژوهش، چیستی حقوق بشر از نظر معنا و ماهیت و بررسی تعریف‌ها و اصطلاحات آن مورد بحث قرار گرفته است. به دلیل آنکه حقوق بشر از دو واژه «حق» و «بشر» ترکیب شده، تبیین معنای آن وابسته به تبیین مفاهیم حق و بشر است. اختلاف نظر درباره ماهیت حق و حقیقت بشر، دستیابی به تعریف و تفسیر جامع از حقوق بشر را نیز دشوار ساخته است. مقاله حاضر با بررسی دیدگاه‌های مختلف در معنای حق و بررسی نگرش اسلام و حقوق بشر مدرن درباره انسان، به تبیین معنای حقوق بشر پرداخته و در نهایت، هویت مشترک همه تعریف‌ها را در این می‌داند که: حقوق بشر مربوط به انسان بما هو انسان است و در برخورداری از آن جز انسان بودن، هیچ‌گونه قیدی لحاظ نمی‌گردد، لکن به دلیل اختلاف نظر در چیستی «حق» و «حقیقت انسان»، این حقوق به صورت‌های گوناگون تفسیر شده است. چنان‌که وجود تفسیرهای مختلف از آن، سبب شده تا مفهوم این حقوق در یک اصطلاح خاص، تنها بر حقوق بشر مدرن اطلاق گردد.<br /> <br />برای دریافت اصل مقاله، از نورمگز و یا مگیران ، آدرس های زیر را کپی و در نوار آدرس مرورگر خود وارد نمایید:<br />مگیران:<br /> https://www.magiran.com/paper/1961113<br />نورمگز:<br />https://www.noormags.ir/view/fa/articlepage/1444078 http://fvh.journals.miu.ac.ir/article_2391_baf03812e3b0625163699fa3cfde540f.pdf
