Imam Khomeini, considering the sensitive position of this council, considered any insult and weakening towards it as a dangerous thing for the country and Islam, and therefore criminalized such an act as one of the examples of corruption on earth. Exactitude consideration of jurisprudential standards and also explicit meaning of Article 286 of the Islamic Penal Code (adopted in 1392), confines the inclusion of this canon to cases where offensive behavior and a series of acts of sabotage in a large and widespread manner is done, in order to weaken the Guardian Council and its structure, and cause disruption and insecurity in the Islamic society. The sensitive and decisive position of the Guardian Council, which, together with the three branches of government, the legislature, the judiciary, the Assembly of Experts, and the Expediency Council, is responsible for managing and deciding on a part of the Islamic Republic, doubles the need for studying on a proper criminal response for weakening and insulting this council.
