The jurisprudential rules governing the convergence of Islamic and non-Islamic countries refer to the principles regulating the behavior of states, institutions, and international organizations. There is a notable alignment between Islamic jurisprudence and international law in most political and economic issues, particularly in the principles of international relations and the United Nations Charter. The primary issue lies in elucidating the type of reaction an Islamic state should have towards non-Islamic states, for which Islamic jurisprudence offers fundamental measures to prevent unforeseen events.
The aim of this research is to explore the scope of jurisprudential rules on a global scale. The most important principles of foreign policy for an Islamic state in the international arena include the principle of invitation (Da'wah), denial of domination, reconciliation of hearts (Ta'lif al-Qulub), cooperation, immunity, as well as the principles of dissimulation (Taqiyya), the lesser of two harms (Aqall al-Dararayn), denial of hardship and distress (Nafi al-Haraj), among others. To this end, the ijtihad and analytical methods in the formation of certain rules and the legitimacy of various forms of economic and regional convergence are instrumental. According to the analytical approach, the jurisprudential rules, principles, and laws governing convergence between states and the regulation of international organizations, particularly in matters of customs tariff facilitation, banking interactions, international loans, the global market, political economy, the World Trade Organization, etc., are of paramount importance.
