Based on Article 189 of the Islamic Jurisprudence, crimes that give rise to hadd and ta’zir cannot be proven by testimony upon testimony. The aforementioned article stems from the well-known Imamiyyah view that some common hadds, such as slander and theft, cannot be proven by testimony upon testimony. Of course, Imamiyyah jurists agree that the rights of God alone are not proven by testimony upon testimony, and the rights of people alone are proven by testimony upon testimony. Given the different effects of the well-known and not-so-well-known views, it is necessary to analyze the aforementioned article and the jurisprudential foundations related to it. The main question that the present study seeks to answer is: “What hadds and ta’zir can be proven by testimony upon testimony?” The findings of the study indicate that due to criticisms that are made on the grounds that testimony upon testimony is not accepted in absolute hadds, and also, due to objections that are made on the grounds that testimony upon testimony is accepted in absolute hadds, testimony upon testimony is acceptable in whatever is among the rights of people. Whether it concerns the testimony of common limits, or punishments based on the violation of people's rights. This research has been conducted with a critical look at the popular view and with a descriptive-analytical method, using ijtihad and library references.
