"Governmentization of formal education" is as controversial as "marketization of knowledge and education" in recent neoliberal approaches! Also, "popularization of formal education" is an attempt to revive the roles and activism of the masses in educational governance and is a basis for the development of "educational participation". The problem of the present article is to examine "the participation of the government in formal public education from the point of view of educational jurisprudence". The research method is a descriptive and inferential method with an emphasis on the ijtihad method. For this purpose, after explaining the issue, eleven reasons for examining the sharia ruling of participation were presented and examined. According to the study of "participation of sovereignty in formal education" in terms of intellectual and rational goodness, and in terms of the desirability of accepting benevolence and responding to benevolence, in terms of the desirability of contributions and cooperation, and in terms of the supreme duty of the sovereignty in education, the desirability of sovereignty and the despicable abandonment of it And from the point of accepting the right and "accepting benevolence and doing what is good" and from the point of avoiding possible harm, and also from the point of the secondary decree, it is obligatory on the sovereign.
