Now that human societies are facing an ever‑increasing rate of crime, a large portion of penal rulings are composed of taʿzīr punishments (discretionary penalties). Relying on only one type of punishment, from economic, cultural, and especially educational (i.e., reformative) perspectives—which constitute the ultimate aims of Islamic rulings—is undesirable. In contemporary Islamic society, most taʿzīr rulings lead to imprisonment; yet, at first glance, this seems contrary to the practice (sīrah) of the Infallibles (peace be upon them).
This study, which seeks to evaluate the applicability and general scope of taʿzīr punishments concerning imprisonment through the lens of the rule “al‑taʿzīr bi‑mā dūna al‑ḥadd” (“discretionary punishment is less than the ḥadd”), adopts a comparative approach and offers a new perspective on the issue—aiming to strengthen the deterrent capacity of punishment by emphasizing its educational and reformative nature.
The basis of the rule “al‑taʿzīr bi‑mā dūna al‑ḥadd” is derived from four groups of narrations. Three groups specify the degree of taʿzīr, though all do so only by way of example. It appears that “mā dūna al‑ḥadd” in the narration is a sign of a general criterion.
