Financial relations between spouses, including mahr (dower), maintenance, dowry property, and entrusted assets, represent one of the principal areas for the regulation of financial rights and obligations in Imamiyyah jurisprudence and Iranian law. In certain instances, these relations are protected not only through civil remedies but also through criminal sanctions. Notwithstanding the existing studies on some individual manifestations of financial misconduct between spouses, a comprehensive inquiry into the juristic foundations of their criminalization remains insufficient. The present study seeks to elucidate the jurisprudential rules governing the criminalization of financial relations between spouses and to clarify their functional and hierarchical interrelationship. Adopting a descriptive-analytical approach based on library research, the study examines five criminalized forms of conduct: failure to provide maintenance, transactions intended to evade debt, destruction of dowry property, sale of dowry property, and breach of trust. The findings demonstrate that the criminalization of such conduct does not rest upon a single uniform basis; rather, it varies according to the nature of the violated financial right and the specific juristic rule governing each case. Therefore, the shift from civil liability to criminal sanction is justified only in cases where, beyond mere financial harm, further elements such as unlawful appropriation, breach of trust, or refusal to perform a legally binding obligation are established.
