Torture is a negative term which hearing it will cause a very bad feelings to a human whom his nature will demonstrate a vision of peace, justice and freedom within the world of human rights, is being under harassments of another humans. The torture of a human by another human is an irritating subject but it is an undeniable fact. Torture is a violation against human rights and it is an action against the sanctity and dignity of a human. The UN General Assembly condemns this practice and the international law as well as the domestic law of the countries has prohibited it. However torturing defendants and the convicts has an old background as the length of human society’s history. Today, torture is identified as an international crime in International Criminal Law and the UN Convention against Torture, which was approved in 1984, and the Statute of the International Criminal Court and many other international treaties. Within the international custom, prohibition of torture has been accepted as an international Jus Cogens. The international criminal law and the majority of the domestic criminal law of countries have considered penalties for committing such a crime and for its jurisdictions, all three types of jurisdictions (territorial, personal and universal) are applicable.
