All the people of the Islamic society need to refer to the religious scholars. These scholars, if they have absolute ijtihad, assuming that they have other conditions, the possibility of referring to them is the place of consensus of the jurists, but in the case of accessibility of absolute mujtahid, is it possible to follow the partial mujtahid according to reasoned jurisprudence? There are three main ideas about the question among the Imamiiah jurists; the first view considers absolute ijtihad as a condition in competence for reference. Some others state that partial ijtihad is absolutely sufficient, and the third view holds that in the absence of an absolute mujtahid, referring to a partial mujtahid is permissible. The findings of this research, which has been done in a descriptive and analytical manner, based on the attitude of the wise and verse 122 of Surah Al-Tawbah, and with regard to the controversies that arise over the reasons for the necessity of absolute ijtihad in the jurist to be followed as Marja', prove that it is absolutely possible to refer to a partial mujtahid. Therefore, the second viewpoint is preferable to the others.
