The coming of age of a girl and a boy to a certain age is what “puberty” is always referred to as the beginning of human’s responsibilities and restrictions. But regardless of its religious basis, puberty is a natural phenomenon with actualization of sexual capacity (human sexuality) and reproductive powers. The criterion (the limitation of sexual ability) and the rule which has been clarified in verse 6 of Surah An-Nisāʾ (Arabic: ٱلنِّسَاء, An-Nisāʾ; meaning: The Women). Although many ḥadīths (Arabic: حَدیث, ḥadīṯ, pl. aḥādīth, أحادیث, ʾaḥādīṯ, literally “talk” or “discourse”) and narrations have mentioned various signs for interpreting this stage of sexual ability and have stated several ages for it, the studies of this research show that jurisprudential evidence established for determining age as a measure of maturity for individuals can be criticized. In addition, these proofs contradict the fact of puberty mentioned in the verse, because attention to maturity from the point of view of ability and fertility is affected by many factors such as climate and weather characteristics. This is why many ages that have been concerned about the need of the audience of the research have been expressed in narrations (traditions). However, this issue has not been considered much in jurisprudence and legal fields and dynamic jurisprudence is expected to have a fundamental review of the issue.
