The issue of refusal of a woman to fulfill her marital duties (Arabic: نُشوز) is one of the most complex jurisprudential and legal issues. The wife’s disobedience due to refusal to obey gives the husband the right to terminate his obligation to pay alimony and the wife’s right to swear an oath is terminated and the injunction of lawsuit of the action for restitution of conjugal rights is arisen, and finally the husband can divorce the wife. For many years, the courts have issued the injunction of the action for restitution of conjugal rights, but they cannot enforce it like other rulings. How is it possible that the execution of the court can force a woman to obey her husband physically and mentally?! Our question in this article is whether there is a potential in Iranian law to resort to criminal reactions in addition to civil reactions against a wife who refuses to perform conjugal obligations. The hypothesis that we prove is that despite the doubts about the effectiveness of the criminal sanctity in the family center, it is necessary to criminalize the wife’s refusal to perform conjugal obligations, because such refusal is contrary to the transcendent interests of the Sharīʿah and its negative social effects. Indisputably, in this regard, the punishment will be possible if the wife’s disobedience is proven in court. The research method is documentary and library-based.
