The issue of juvenile delinquency and the corresponding responses holds paramount importance in most societal systems, considering the pivotal role of the family in shaping the character and social integration of children and adolescents. Emphasizing the necessity of preserving this role in addressing juvenile delinquency, this article undertakes an examination within the contexts of Imami jurisprudence and the criminal laws of Iran and France, employing a descriptive-analytical methodology.
Islam, acknowledging the weighty responsibilities imposed on parents and the associated rights and duties concerning the critical realm of upbringing, has endowed the family with an exceptional role. Positioned centrally in both proactive and reactive responses to juvenile delinquency, the family's role is favored over governmental punitive measures. Examples of these responses include religious upbringing, provision of vital needs, and disciplining the child. Such familial responses take precedence over state-imposed penal measures, underscoring the family's role within the frameworks of Iranian and French criminal laws.
Key aspects, including the acceptance of primary and substitute family guardianship, coupled with securing necessary assurances from them, exemplify attention given to the family's role in addressing juvenile delinquency. Despite considerations in Iranian and French criminal laws, serious deficiencies exist, as asserted within the framework of Islamic teachings
