Among the disputed issues in the legal schools is the issue of attributing adultery to the mother, on which two different views have been raised. Famous Sunni jurists and some Imamiyyah jurists believe in joining the lineage of adulterous children to the mother. The main document of this point of view is some narrations and rational arguments. On the other hand, famous Imamiyyah jurists and some Ahl al-Sunnats have believed in non-affiliation.The main source of the difference is that some people have mentioned the birth and the truth of the title "Wald" as the main reason for the attachment of the child to the mother, and on the other hand, some have insisted on the non-lawfulness of their relationship and non-marriage to deny the attribution of adultery to the mother. areThe present article investigated the mentioned issue with a descriptive-analytical method and with a problem-oriented perspective, and after analyzing and evaluating the evidence, it came to the conclusion that due to the lack of proof of the legal truth of the word "Wald", authentic narrations in various chapters of jurisprudence and the generality of the evidence to Mother joins.
