Guardianship and adoption have long been established practices in various societies. This study begins by examining the legal status of adopted children in Iran and international documents, particularly the Convention on the Rights of the Child (CRC). Numerous international conventions concerning adoption have been ratified, all aimed at ensuring the best interests and protection of these vulnerable children. The Iranian legislator has somewhat shifted its perspective on adoption, taking steps to prioritize the welfare of children.In the event that this legal institution is accepted, what law governs the legal relationship of individuals who are considered foreign nationals in another country and seek to apply for adoption? This article compares domestic laws with international regulations while acknowledging the fundamental principles involved and identifies several legal implications that arise from this matter. When a foreign national applies for adoption in another country, the legal effects stemming from this application can create conflicts of law due to the presence of foreign elements and the differences in the nationality of the adopted child and the adopting parent. Generally, the court where the case is filed will apply the relevant conflict-of-laws rules to determine the appropriate governing law.
