This article addresses the question of how and to what extent, despite the analysis of paternal guardianship concerning the administration of a minor’s affairs, protection of the ward, permission, custody, and financial and legal decisions, the identity-forming upbringing of a child lacking full legal capacity can be explained. Its aim is to analyze the protective function of paternal guardianship in non-financial interests and to determine its boundary with the expansion of the ruling of guardianship, unrestricted paternal authority, and identity imposition. Relying on library and documentary sources, this research addresses the question of how the scope of paternal guardianship, the protective criterion of guardianship, the welfare and best interests of the ward, human dignity, the prohibition of harm, the negation of unbearable hardship, and legal supervision over the exercise of guardianship can contribute to limiting and explaining the protective function of paternal guardianship in the identity-forming upbringing of a child lacking full legal capacity. The article distinguishes between invoking the protective criterion of guardianship and extending the ruling of financial guardianship to identity and upbringing. The findings show that this function is defensible only within responsible, fiduciary, welfare-oriented, and dignity-based guardianship, with respect for the child’s gradual development, dignity, and ascertainable welfare. The conclusion is that this function neither expands the ruling of guardianship nor permits identity imposition; rather, harmful coercion, humiliation, violence, suppression of the child’s developing personality, or identity imposition falls outside its legitimate limits.
