Coordinating the execution of the sentence of deprivation of life with the organ donation process is one of the new and challenging issues in the legal system of Iran, which, pursuant to Article 47 of the Code of Procedure for Execution of Sentences of Hodud, Deprivation of Life, and Retribution (Qisas) approved in 2019, has found initial permission, but lacks a clear and codified executive directive. The present research, using an analytical-descriptive method and utilizing library and documentary sources, seeks to analyze the jurisprudential, legal, medical-ethical, and socio-cultural challenges of this coordination. The research findings indicate that this approach faces three major categories of challenges: First, jurisprudential challenges including the rule prohibiting harm to oneself (especially in the removal of vital organs from the living convict), the rule prohibiting mutilation, ambiguity in the realization of the concept of "taking the soul" in modern methods (such as induced brain death); and in the second step, legal gaps such as the lack of an executive directive for Article 47 and conflict with Articles 40 and 42 of the aforementioned code. Third, medical-ethical challenges including the distortion of the convict's informed and free consent due to psychological pressures resulting from the execution of the sentence, the risk of instrumentalization and reduction of the convict's human dignity to an "organ source," and the possibility of systematic corruption and the creation of informal organ markets (black market for organs).
